The 4-stage late payment escalation

Think of chasing late invoices as a ladder. You start friendly and professional — most invoices are paid in the first 1-2 steps. You escalate only when needed.

Template 1: Friendly first reminder (day 3–5)

The most effective reminder is the one that assumes good faith. Most clients pay after this.

Subject: Invoice #[NUMBER] — Payment due Hi [Client Name], Just a quick note — Invoice #[NUMBER] for £/$/€[AMOUNT] was due on [DATE]. If you've already sent payment, please ignore this — it may have crossed in the post. If not, here's the invoice for your reference: [LINK or ATTACHMENT] Payment details: [Bank/PayPal/Stripe link] Let me know if you have any questions. Thanks, [Your Name]

Template 2: Firm second reminder (day 7–10)

Still no payment. Time to be more direct while staying professional.

Subject: Invoice #[NUMBER] — Now [X] days overdue Hi [Client Name], I'm following up on Invoice #[NUMBER] for £/$/€[AMOUNT], which was due on [DATE] and is now [X] days overdue. I haven't received payment or a response to my previous reminder sent on [DATE]. Could you please confirm when you're able to process this? I'd appreciate payment by [DATE + 5 DAYS] if possible. Template 3: Urgent notice (day 14–21)

Now you need to mention consequences. Late fees may apply. Keep it professional.

Subject: Urgent — Invoice #[NUMBER] — £/$/€[AMOUNT] Overdue Hi [Client Name], Invoice #[NUMBER] for £/$/€[AMOUNT] is now [X] days overdue. I've sent two previous reminders and have not received payment or a response. I'm now required to flag this as seriously overdue. Per our payment terms, a late fee of [X]% per month may be applied to balances outstanding beyond [original term] days. Template 4: Pre-legal notice (day 25–30)

One more step before the formal LBA — gives the client a final chance to settle.

Subject: Final Notice Before Legal Action — Invoice #[NUMBER] Dear [Client Name], This is my final notice before I take formal action to recover the outstanding balance on Invoice #[NUMBER] for £/$/€[AMOUNT], due [DATE] — now [X] days overdue. Previous reminders were sent on: [DATE 1], [DATE 2], [DATE 3]. If payment of £/$/€[AMOUNT] is not received by [FINAL DATE], I will have no choice but to: 1. Issue a formal Letter Before Action 2. Template 5: Formal Letter Before Action (LBA)

This is a legal document. Send by email and recorded post. Required before court in most jurisdictions.

Template 6: Payment plan offer

For long-standing clients who are genuinely struggling — sometimes this is better than a legal fight.

Subject: Invoice #[NUMBER] — Payment Plan Option Hi [Client Name], I understand that cash flow can be challenging. To help resolve Invoice #[NUMBER] for £/$/€[AMOUNT], I'm prepared to offer a short-term payment plan: Option A: 50% by [DATE 1], 50% by [DATE 2] Option B: 3 equal payments of £/$/€[AMOUNT/3] on [DATE 1], [DATE 2], [DATE 3] Please reply to confirm which option works for you by [DATE + 3 DAYS]. Your legal rights on late payment

🇬🇧 United Kingdom

Under the Late Payment of Commercial Debts Act 1998, you can claim statutory interest of 8% above base rate on B2B invoices. Plus £40–100 in fixed compensation per invoice.

🇺🇸 United States

No federal law — depends on state and contract terms. Include a late fee clause in your contract (typically 1.5%/mo). Small claims limits vary by state ($2,500–$25,000).

🇪🇺 European Union

EU Directive 2011/7/EU: B2B invoices default to 30-day payment terms. Statutory interest: ECB rate + 8%. Recovery costs: €40 minimum.

🇦🇺 Australia

No uniform law. Include late fees in your contract. Small claims via NCAT (NSW) or QCAT (QLD) — fast and cheap for under $25,000.
